1. PREAMBLE
Definitions
The general terms and conditions of sale described below detail the rights and obligations of Virginie Balandras' micro-business (Cool le chien) and its customers in the context of the online sale of products on the coollechien.com website.
Products: items available for sale on the coollechien.com website.
Buyer / Customer: natural person acquiring Products via the coollechien.com website.
Seller: Virginie Balandras, micro-business registered under number 829 245 976, Siret: 829 245 976 00024, NAF: 9609Z, Registered office: carrefour des 4 chemins, Marigot 97133 Saint-Barthélemy. cool.lechien@gmail.com.

Scope of application
These general conditions of sale (hereinafter referred to as the "Conditions") are reserved exclusively for consumer and non-professional buyers. They govern sales by the micro enterprise Virginie Balandras (Cool le chien) (micro enterprise registered under number 829 245 976, Siret: 829 245 976 00024, NAF: 9609Z, Head Office: carrefour des 4 chemins, Marigot 97133 Saint-Barthélemy. cool.lechien@gmail.com) of goods available for sale on the coollechien.com website. Cool le chien reserves the right not to process orders from any person who is not a "final consumer" or orders that do not comply with its commercial policy as defined herein.
The Conditions are subject to French law.
Any order placed with Cool le chien therefore implies the Customer's unreserved acceptance of these conditions. These general conditions may be modified at any time and without prior notice by Cool le chien. The applicable conditions are those in force on the date of the order by the Customer.
Acceptance
The Conditions are tacitly accepted by the validation of the order by the Customer. By proceeding with payment, the Customer indicates that he/she accepts these Conditions without reservation.
Evidence
The Vendor and the Buyer agree that the e-mails exchanged between them are valid proof of the content of their exchanges and, where applicable, of their commitments, particularly with regard to the transmission and acceptance of orders.
The data recorded by Cool le chien's services when orders are validated constitutes proof of all transactions between the Vendor and its Customers. The data recorded by the payment system constitutes proof of the financial transactions.
Responsibility
The Seller, in the online sales process, shall only be bound by an obligation of means: it shall not be held liable for any damage resulting from the use of the Internet network, such as loss of data, intrusion, virus, hacking, breakdown in service or other involuntary problems.
Applicable law
This site is subject to French law.
In the event of a legal dispute, the French courts shall have sole jurisdiction.
2. PRODUCTS
Characteristics and description of the Products
The items sold by Cool le chien are guaranteed new and have not, under any circumstances, been the subject of prior use. The photographs are intended to be as faithful as possible to the products sold, but the colours may undergo slight modifications from one computer screen to another without the Vendor's liability being incurred or the legality of the sale being challenged.
Under no circumstances is the Customer authorised to download or modify all or part of the Site and in particular its content (products listed, descriptions, images, videos, etc.). Under no circumstances may this Site or any part of it be reproduced, copied, sold or exploited for commercial purposes without the express written authorisation of Cool le chien.
Generally speaking, all copyrights, trademarks and other distinctive signs and property or intellectual property rights appearing on the Site shall remain the full and complete property of Cool le chien.
The Customer is therefore bound to respect intellectual property rights and may in no way use the trademarks appearing on the Site and on the Products where applicable, or register a trademark that would be prejudicial to the holder of the rights, unless otherwise stipulated in the contract. The same applies to any other intellectual property rights.
Availability of Products
The offers presented by the Seller are valid as long as they are visible on the site, within the limits of available stocks.
When a Product is no longer available, it is displayed as "Victim of its own success", and it is then no longer possible to order it, unless a pre-order is indicated.
On receipt of orders, the Seller checks the availability of the Products ordered.
In the event that a Product ordered by the Buyer is unavailable, the Seller undertakes to inform the Buyer by e-mail as soon as it becomes aware of such unavailability. In the event of unavailability, the Vendor undertakes to offer an exchange or refund the Customer within 30 days of payment of the order.
3. PRICES
Displayed prices
Prices are quoted in euros and include all taxes, but exclude delivery charges and customs duties, which will be payable by the Buyer.
The amount of VAT and delivery costs is specified to the Customer at the end of the selection of the various Products.
The Vendor reserves the right to modify its prices at any time, but the Products ordered are invoiced at the price in force when the order is registered.
The Products remain the property of Cool le chien until full payment has been received. Please note: as soon as you take physical possession of the Products ordered, the risks of loss or damage to the Products are transferred to you.
4. ORDER PROCESSING
Customer obligations
The site is freely accessible without registration, but all orders require registration by the Customer.
The Customer declares that he/she is at least 18 years old and has the legal capacity or parental authorisation to place an order on the Site.
When ordering for the first time, the Customer must create an online account by entering his/her personal details. The Customer undertakes to provide Cool le chien with the actual information required to carry out the service that is the subject of these terms and conditions, as requested online and according to their situation, in particular their surname, first name, address, telephone number and valid e-mail address.
They must keep this information up to date and ensure that it is accurate. Customers may modify their details in the "my account" section. The following details are compulsory: e-mail address, first name, surname, delivery address, invoicing address and telephone number.
The Customer is responsible for any consequences arising from false or inaccurate information provided or information that is unlawfully included. The Seller reserves the right to close an account if the Buyer is in breach of applicable laws, these Conditions or any other terms, conditions, guidelines or policy of Cool le chien. Before proceeding with the purchase of the Products, by transmitting the order form, the Customer is asked to read these Conditions carefully. Once the order has been placed, Cool le chien will send the Customer an e-mail confirming the order. It informs the Customer of the dispatch of the Products.
Any order placed on the coollechien.com website implies acceptance of these General Terms and Conditions. Any order confirmation implies your full and complete acceptance of these General Terms and Conditions of Sale, without exception or reservation.
Personal data
The Seller undertakes not to communicate to third parties any personal data concerning the Customer without the latter's authorisation. This data will only be used by the Vendor's internal departments to process the order and to communicate Cool le chien news (newsletter registration, which the Customer may unsubscribe from at any time using a form or by simple request sent by e-mail to cool.lechien@gmail.com).
In accordance with the French Data Protection Act of 6 January 1978, as amended by the Act of 6 August 2004, the Customer has the right to access and rectify any personal data concerning him or her. To do so, they simply need to send a request by e-mail to cool.lechien@gmail.com, stating their surname, first name and address.
Order validation
Before validating his/her order, the Customer is invited to check, item by item, that the number, colour, size and price are taken into account in the order form.
The Customer validates his/her order when he/she activates the "Validate my order" link on the "Confirmation" page after having accepted the General Terms and Conditions of Sale.
Cool le chien reserves the right to cancel or refuse an order in the event of a dispute with the Customer over a previous order. Cool le chien may accept orders subject to availability. It informs the Customer of the availability of the Products sold on the Site when the order is confirmed.
Cool le chien shall in no way be held liable for the Products being permanently or temporarily unavailable, nor shall such unavailability give rise to any right to compensation or damages in favour of the Customer. The Vendor confirms the order by means of an e-mail which includes all the elements of the order. The data recorded by Cool le chien constitutes proof of the nature, content and date of the order.
5. PAYMENT AND SECURITY OF TRANSACTIONS
All orders must be paid for in euros.
Payment must be made in full when the order is placed. At no time may the sums paid be considered as deposits or advance payments. Orders are paid for by credit card using the secure online payment system integrated into the Vendor's website.
For all transactions, the Customer shall indicate the number appearing on the front of his/her card, the expiry date of his/her card and the cryptogram appearing on the back of his/her card (last three digits).
Cool le chien retains ownership of the item until full payment of the price by the Customer. Purchases are made securely. The payment solutions adopted by Cool le chien are 100% secure. For payments by bank card (Carte Bleue, Carte Bleue Visa and Mastercard, e-Carte Bleue and American Express), all the information that Customers communicate to Cool le chien is strictly protected and guarantees the conformity and security of each transaction.
No COD shipments will be accepted for any reason whatsoever.
An invoice will be sent to the Customer once payment has been made and will be given to the Customer upon delivery of the order. Any exchange and bank charges will be borne by the Buyer.
In order to prevent fraud, the Vendor may ask the Buyer to provide a copy of his/her identity card and proof of address in order to validate the order. The Vendor undertakes to destroy all documents provided in this context once the checks have been carried out.
6. DELIVERY
For deliveries in mainland France, the products are sent with the delivery note to the delivery address indicated by the Customer at the time of ordering. Delivery cannot be made to hotels or post office boxes. The delivery times indicated on the site are indicative times, corresponding to average processing and delivery times.
In order for these deadlines to be met, the Customer must ensure that they have provided accurate and complete information concerning the delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.). It is to this address that the parcel will be sent.
Cool le chien cannot be held responsible for any input errors and the consequences in terms of delays or delivery errors. In this context, all costs incurred for the possible re-shipment of an order will be charged to the buyer.
For deliveries to Saint Barthélémy 97133, the parcel will be left free of charge at a delivery point indicated by the seller when the order is validated.
Order processing
The Seller undertakes to process the Order as quickly as possible, generally within two working days, and within a maximum of 30 days following validation of the order.
Packages are dispatched from Monday to Saturday within 2 working days of an order being validated and paid for, except on public holidays, where otherwise stated and subject to product availability.
All orders placed between Friday 3pm and Sunday evening will be processed from the following Monday, except on public holidays.
For mainland France, an e-mail informs the customer that the parcel has been handed over to the carrier and provides a tracking number so that the customer can follow the shipping stages.
Delivery time in mainland France is usually 2 to 5 days depending on the shipping method chosen and 10 to 18 days in Overseas France directly to a relay point.
Cool le chien delivers its Products to St Barthélemy 97133 and mainland France. Generally, delivery is always free of charge but Cool le chien reserves the right, in exceptional cases, to ask for a contribution towards postage costs. All parcels are sent via La Poste.
Delivery times
All orders are delivered without any guarantee as to delivery times. Exceeding the delivery times given purely as an indication may not give rise to damages. Delivery times given as an indication are those communicated by the carriers. Neither the carrier nor the Vendor may be held liable in the event of delivery being impossible due to inaccuracy in the delivery address (it being specified that the designation of post office boxes is prohibited).
Delivery to a Relay Point
You will be notified by email and SMS as soon as your parcel is available at the Point Relais. Your parcel will be available during shop opening hours. You then have 8 days to collect it, on presentation of proof of identity. A reminder will be sent to you by e-mail or text message after 4 days.
Limitation of liability
In the event of a parcel being returned due to the customer's absence, a problem with the delivery address or the impossibility of receiving the parcel within the allotted time, the delivery charges will be payable. In the event of re-shipment, the cost of re-shipment will be borne by the customer.
Cool le chien cannot be held responsible in the event of disruption, total or partial strike by the postal services and/or carriers.
Inspection on receipt
It is the Customer's responsibility, in the event of reservations relating to the transport of the Products sold, particularly in the event of damage or missing items, to make all the necessary observations and note them on the delivery note. The Customer must contact the Vendor within 2 days.
In the event of damaged packages (already opened, missing products, etc.), the Customer undertakes to notify the carrier and Cool le chien by registered letter with acknowledgement of receipt within 2 days of receipt of the Products.
7. RETURNS AND EXCHANGES
Refund and exchange conditions
Pursuant to Article L.120-20 of the French Consumer Code, the Buyer has a period of 14 working days from the date of receipt (right of withdrawal) to return the Products to the Seller, without having to give any particular reason, for an exchange or refund. The cost of returning the Products shall be borne by the Buyer.
Items must be returned in their original packaging and in perfect condition for resale. Otherwise, the Products will not be reimbursed, taken back or exchanged.
Products returned incomplete, damaged or soiled will not be taken back and will be returned to the Customer in their original condition, at the Customer's expense.
The exchange is at the Customer's risk. The Product must be returned within one week in its original packaging, in its original condition, new, unworn, unwashed, accompanied by the return slip, to the following address indicated by the seller.
Requesting a return
To request a return, the Customer must first send an exchange request by e-mail to: cool.lechien@gmail.com, quoting the order number and the Customer's full contact details.
Confirmation of receipt of this return request will be sent by e-mail. Upon receipt of the agreement, the Customer has 14 days to return the Product. After this period, the return will be refused.
Refunds
Only once it has been verified that all these conditions have been met will the Seller refund the sums received for the returned items, with the exception of the return costs. The Vendor undertakes to reimburse the Buyer without delay (by bank transfer), and at the latest within 14 days of the date of receipt of the returned products.
In the event that the above conditions are not respected, no reimbursement will be due: the Customer will remain the owner of the Product, which will be returned at his/her expense.

This Site or any part of this Site must under no circumstances be reproduced, copied, sold or exploited for commercial reasons without the express written permission of Cool le chien.

Availability of Products
The offers presented by the Seller are valid as long as they are visible on the site, while stocks last.
When a Product is no longer available, it displays "Out of stock", and it is then no longer possible to order it unless pre-ordered.
Upon receipt of orders, the Seller checks the availability of the Products ordered.
In the event that a Product ordered by the Buyer is unavailable, the Seller undertakes to inform the Buyer by e-mail as soon as it becomes aware of this unavailability. In the event of unavailability, the Seller undertakes to offer an exchange or reimburse the Customer within 30 days of payment of the order.
3. PRICE
Prices displayed
Prices are indicated in euros, all taxes included, excluding shipping costs and customs duties which will be the responsibility of the Buyer.
The amount of VAT and shipping costs is specified to the Customer at the end of the selection of the different Products.
The Seller reserves the right to modify its prices at any time, but the Products ordered are invoiced at the price in effect when the order is registered.
The products remain the property of Cool le chien until full payment of the price. Please note: as soon as you take physical possession of the products ordered, the risk of loss or damage to the products is transferred to you.
4. ORDER PROCESS
Customer Obligations
The site is freely accessible without registration, but any order requires the Customer's registration.
The Customer declares to be at least 18 years old and to have the legal capacity or to hold parental authorization allowing him to place an order on the Site.

He must keep them updated and ensure their accuracy. The Customer can modify his data in the “my account” section. The following are required: e-mail, first name, last name, delivery address, billing address, telephone number.
The Customer is responsible for the consequences resulting from false or inaccurate information transmitted or the resumption of which would be unlawful. Seller reserves the right to terminate an account if Buyer is in violation of applicable laws, these Terms or any other terms, conditions, guidelines or policies of Cool the Dog. Before purchasing the Products, by submitting the order form, the Customer is asked to read these Conditions carefully. Once the order has been placed, Cool the dog sends the Customer an e-mail confirming it. He informs him of the sending of the Products.
Any order appearing on the website coollechien.com assumes adherence to these General Conditions. Any order confirmation implies your full and complete acceptance of these General Conditions of Sale, without exception or reservation.
Personal data
The Seller undertakes not to communicate personal data concerning the Customer to third parties without the latter's authorization. These data will only be used by the Seller's internal services for the processing of the order and the communication of Cool le chien news (subscription to the newsletter from which the Customer may unsubscribe at any time using a form or upon simple request sent by email to cool.lechien@gmail.com).
In accordance with the amended Data Protection Act of January 6, 1978 amended by the law of August 6, 2004, the Customer has a right of access and rectification to personal data concerning him. To do this, simply make the request by e-mail to cool.lechien@gmail.com with mention of your surname, first name and address.
Confirmation of the order
Before validating his order, the Buyer is invited to check, item by item, that the number, color, size and price are taken into account in the order form.

No cash on delivery will be accepted, whatever the reason.
An invoice is sent to the Customer once payment has been made and delivered upon delivery of the order. Any exchange and bank charges will be the responsibility of the Buyer.
As part of fraud prevention, the Seller may ask the Buyer to provide a copy of their identity document and proof of address to validate their order. The Seller undertakes to destroy all documents provided in this context once the checks have been carried out.
6. LIVRAISON
Pour les livraison en France métropolitaine, les produits sont expédiés avec le bon de livraison, à l’adresse de livraison indiquée par le Client lors de sa commande. La livraison ne peut être effectuée ni dans des hôtels, ni à des boîtes postales. Les délais de livraison indiqués sur le site sont des délais indicatifs, correspondant aux délais moyens de traitement et de livraison.
Afin que ces délais soient respectées, le Client doit s’assurer d’avoir communiqué des informations exactes et complètes concernant l’adresse de livraison (tels que, notamment : n° de rue, de bâtiment, d’escalier, codes d’accès, noms et/ou numéros d’interphone, etc.). En effet, c’est à cette adresse que le colis sera expédié.
Cool le chien ne saurait être tenu responsable d’éventuelles erreurs de saisie et des conséquences en termes de retard ou d’erreur de livraison. Dans ce contexte, tous les frais engagés pour la réexpédition éventuelle d'une commande seront à la charge de l’acheteur.
Pour les livraisons à Saint Barthélémy 97133, le colis sera déposé gratuitement en point relais indiqué par le vendeur à validation de la commande.
Traitement des commandes
Le Vendeur s’engage à traiter la Commande au plus vite, généralement sous deux jours ouvrables, et dans un délai maximum de 30 jours suivant la validation de la commande.
Les colis sont expédiés du lundi au samedi dans les 2 jours ouvrés suivant une commande validée et réglée, sauf jour férié, mention contraire et sous réserve de la disponibilité des produits.
Toute commande passée entre le vendredi 15h et le dimanche soir sera traitée à partir du lundi suivant, sauf jour férié.
Pour la France métropolitaine, un e-mail informe le client de la remise du colis au transporteur et communique un n° de suivi afin de suivre les étapes d'expédition.
Pour St Barthélemy 97133, un e-mail informe le client de la remise du colis au point relais.
Le délai d’acheminement en France métropolitaine est habituellement de 2 à 5 jours selon le mode d'expédition choisi et de 10 à 18 jours en Outre-mer directement en point relais.
Cool le chien livre ses Produits à St Barthélemy 97133 et en France métropolitaine. Généralement la livraison est toujours gratuite mais Cool le chien se réserve le droit, en cas exceptionnel, de demander une participation aux frais de port. Tous les colis sont expédiés via les services de La Poste.
Délais de livraison
Toute commande est livrée sans garantie quant aux délais. Le dépassement des délais donnés à titre purement indicatif ne peut donner lieu à dommages-intérêts. Les délais de livraison donnés à titre indicatif sont ceux communiqués par les transporteurs. La responsabilité du transporteur ou du Vendeur ne saurait être recherchée en cas d’une impossibilité de délivrance due à une imprécision dans l’adresse de livraison (étant précisé que la désignation de boîtes postales est interdite).
Livraison en Point Relais
Vous serez avertis par email et SMS dès la mise à disposition de votre colis dans le Point Relais. Votre colis sera disponible aux heures d'ouverture du magasin. Vous avez alors 8 jours pour venir le retirer, sur présentation d'une pièce d'identité. Une relance vous sera faite par e-mail ou par sms au bout de 4 jours.
Limite de responsabilité
En cas de retour du colis dû à une absence du client, à un problème dans l'adresse de livraison ou à une impossibilité de réceptionner le colis dans les temps impartis, les frais de livraison sont dûs. En cas de réexpédition, les frais de réexpédition seront à la charge du client.
Cool le chien ne saurait être tenu pour responsable en cas de perturbation, grève totale ou partielle des services postaux et/ou des transporteurs.
Contrôle à la réception
Il appartient au Client, en cas de réserves liées au transport des Produits vendus, notamment en cas d’avarie ou de manquants, de faire toutes les constatations nécessaires et de les noter sur le bon de livraison. Il doit rapidement prendre contact avec le Vendeur sous 2 jours.
En cas de colis endommagés (déjà ouvert, produits manquants…), le Client s’engage à notifier au transporteur et à Cool le chien par lettre recommandée avec accusé de réception dans les 2 jours qui suivent la réception des Produits.
Delivery delay

Cool le chien cannot be held responsible in the event of disruption, total or partial strike of postal services and/or carriers.
Inspection upon receipt
It is up to the Customer, in the event of reservations relating to the transport of the Products sold, particularly in the event of damage or missing items, to make all necessary findings and note them on the delivery note. He must quickly contact the Seller within 2 days.
In the event of damaged packages (already opened, missing products, etc.), the Customer undertakes to notify the carrier and Cool le chien by registered letter with acknowledgment of receipt within 2 days following receipt of the Products.
7. RETURN AND EXCHANGE

Return request
For a return request, the Customer must first make an exchange request by e-mail to: cool.lechien@gmail.com mentioning the order number and full contact details of the Buyer.
A confirmation acknowledging receipt of this return request will be sent by email. Upon receipt of agreement, the Customer has 14 days to return the Product. After this period, the return will be refused.
Refund
It is only after verifying that all these conditions are met that the Seller will reimburse the sums collected for the returned items, with the exception of return costs. The Seller undertakes to reimburse the Buyer without delay (by transfer), and at the latest within 14 days following the date of receipt of the returned products.
In the event that the above conditions are not respected, no refund will be payable: the Customer then remains the owner of the Product, which will be returned to him at his expense.
